Expectations for update to regulations per January 1, 2021

The Danish Energy Agency has sent the draft Ministerial Order on technical certification and service of wind turbines etc., in public consultation. The Ministerial Order will replace the Executive Order no. 73 on the technical certification scheme for wind turbines and is expected to enter into force January 1st, 2021. 

The Ministerial Order is a fundamental revision of the Executive Order no. 73 (BEK73) to adapt the Danish regulation of technical certification and service of wind turbines to a modern market. To ensure that wind turbines do not pose a risk for persons and animals as well as property to the surroundings, the Ministerial Order also introduces clearer regulations especially regarding service and maintenance. 

Finally, the Ministerial Order consist of several elaborations and clarifications of existing rules and common practice.

The consultation letter available on Høringsportalen describes some of the proposed changes to the version in hearing (only available in Danish). Below is a brief description of some of the proposed changes.

 

Stricter requirements to service of wind turbines

Owners cannot be approved to perform service on their own wind turbines

The draft proposes to phase out the scheme in the current BEK73, section 9, subsection 3, which makes it possible for wind turbine owners in special circumstances to apply for approval to perform service on their own wind turbine. Going forward, it will only be possible for already approved owners to apply for a renewal of their approval.

Owners with approvals that expire in 2020 must therefore make sure to apply for renewal before the expiration of their current approval.

Non-operational wind turbines must be serviced and secured properly

The draft stipulates e.g. to:

  • a wind turbine that has been taken out of operation must:
    • be secured appropriately and
    • continued to be serviced even if the wind turbine is not in operation and
    • be function and safety tested before it is reinstated into operation.

Wind turbines of or less than 40 m2 must keep a logbook

The draft stipulates e.g. to:

  • the owner of a wind turbine with a rotor area of ​​or less than 40 m2 must keep a logbook of the service performed on the wind turbine.

Service inspections at least annually, unless otherwise stated in the service manual

The draft stipulates e.g. to:

  • the servicing interval must be in accordance with the service manual, and if not stated, service inspections must be performed in intervals no longer than 1 year.

The draft proposes to clarify the owner's duties of reporting and in the follow-up process in relation to damages and accidents.
